Trademark Law


The following is brief description of the various trademark transactions which our firm handles:

Trademark Registration

In 1997, the firm registered 152 trademarks, an increase of 18% over the trademarks issued in 1996. These figures are for federal registrations issued by the United States Patent and Trademark Office. Registrations cover a broad range of goods and services, including collective membership, certification marks and concurrent use registrations.

Opposition, Cancellation, and Concurrent Use Proceedings
The firm has extensive involvement in these cases and, on average, carries a docket of 20--30 cases before the Trademark Trial and Appeal Board. Appeals
We are very proud of the positive results we have achieved on behalf of clients at the Appellate level, both Federal, and Administrative. Within the past six months, we have successfully reversed the Examining Attorney's decision refusing registration of trademarks on two separate occasions. A number of cases handled by our firm are cited as precedent. See e.g. In re Waverly, Inc. 27 USPQ2d 1620 (TTAB 1993). We have also obtained reversal of TTAB decisions at the Court of Appeals for the Federal Circuit.

Searching
Our firm conducts a wide range of searching on behalf of clients, including searches of the federal, state, and company name listings. Our staff includes three full time and one part time employees working solely within this field. We conduct Registrability, Index, Company Name, Assignment, Litigation, and Infringement Searches on a routine basis. Our office is fully equipped to obtain file histories from the U.S. Patent and Trademark Office and to deal directly with personnel at the PTO. Each member of our staff has a working relationship with the PTO and many of its personnel. Firms throughout the nation utilize our services in getting things done which are difficult to accomplish by telephone or written communications.

Authentication and Legalization
Our firm obtains certified documents from the United States Patent and Trademark Office, routinely writes letters to state authorities to obtain state certified documents for further legalization, authentication of documents before the U.S. Department of State, and obtains legalization of documents before all foreign embassies here in Washington, D.C.

Informed Compliance

We assist and advise clients on their legal obligations, associated with product labeling, to avoid federal penalties. We also assist clients with proper trademark display and notation. Our practice is extended to include enforcement of trademarks under the U.S. Customs Laws. We regularly record registered trademarks and copyrights with Customs.

Licensing
Our firm is fully equipped to handle all commercial licensing matters. We routinely draft Licensing Agreements for clients and review Licenses drafted by others.

Monitoring

Our staff reviews the Official Gazettes, published weekly by the U.S. Patent and Trademark Office, and provides specific monitor and watch services for clients that request it.
